Location-Based Services Terms
This is an English translation of the Korean Location-Based Services Terms. If the two differ, the Korean version prevails — except that for consumers habitually resident in the EEA, the United Kingdom or Switzerland, this English version is also binding and any difference is interpreted in the consumer’s favour.
These Terms set out the BapsangLog features that use your location and the conditions for using them. Only people who have agreed to these Terms can use the features that use location.
Key points — please read first
· Location consent is optional. Even if you do not consent, you can still sign up, rate, save places and browse as usual. Only features that use your location, such as “Near me” and the my-location button on the map (“Go to my location”), are unavailable. (Articles 5 and 6)
· Coordinates are not stored. Your location is rounded on your device and sent without sign-in information. The server uses it only to find nearby places and does not store it. (Articles 4 and 7)
· Use records are kept for 6 months. As required by law, the Company automatically records when and which location feature was used. These records kept by the Company do not include coordinates or IP addresses. However, the request logs of the company that operates the servers keep the access time and IP address for up to 7 days, as they do for any other request. (Article 8)
· You can pause or withdraw at any time. In MY → ☰ (Settings) → Location, you can pause for a while, turn off a single feature, or withdraw your consent entirely. When you turn off a feature or withdraw consent, the use records it covers are deleted immediately. (Article 10)
· When these Terms change, changes that affect users’ rights and obligations are notified separately 30 days in advance through “Notices” under MY and push notifications, and if you do not object by the effective date, you will be treated as agreeing. Changes that make more use of location or are unfavorable to users require your consent again. Changes that do not affect rights and obligations, such as correcting the Company’s address or contact details or only polishing the wording, are announced on this page 7 days in advance. (Article 3)
· The Company is not liable for damage that arises without intent or negligence on its part. Damage caused because the location your device reported differed from your actual location is one example. However, for damage caused by the Company’s violation of the Location Information Act, the Company compensates you unless it proves that there was no intent or negligence on its part. (Articles 15 and 16)
Article 1 (Purpose)
- These Terms set out the conditions and procedures for using the location-based services that Nonscale Co., Ltd. (주식회사 논스케일, the “Company”) provides in the BapsangLog app and website (bapsanglog.com, the “Service”), and the rights and obligations of the Company and users.
- These Terms apply together with the Terms of Service. Anything not covered by these Terms is governed by the Act on the Protection, Use, etc. of Location Information (the “Location Information Act”), the Personal Information Protection Act (PIPA) and other applicable laws, and by the Terms of Service and the Privacy Policy.
Article 2 (Definitions)
- Location information — information about where a device (a phone or computer) was at a given time. In the Service, it means the coordinates (latitude and longitude) reported by your device’s operating system or browser.
- Personal location information — location information about a specific person. It includes location that cannot identify a person on its own but can easily be combined with other information to do so. The Company treats a member’s location when the member uses a location feature as personal location information.
- Location features — the features that use your location under these Terms, namely “Near me” and your location on the map (Article 4).
- Location consent — the consent a member gives under these Terms to the use of their own location.
- Use records — the “records confirming the use and provision of location information” required by the Location Information Act. They record where the location was obtained (source), when and how it was used, and to whom it was provided. They do not contain the location itself (Article 8).
- Member · non-member — a member is a user who has signed in and created an account; a non-member is a user who uses the Service without signing in. Other terms have the meanings given in the Terms of Service.
Article 3 (Posting and changing these Terms)
- The Company posts these Terms at bapsanglog.com/en/location-terms and puts a link to these Terms on every screen that asks for location consent. You can view, save or print this page at any time. Earlier versions can be viewed, exactly as posted, in the version history.
- The Company changes these Terms only in the following cases, and only within the limits of applicable law: when it adds, changes or removes a location feature or the way it handles location (what is sent, retention, provision, the map service); when applicable laws or government guidelines change; when it transfers the business, or when the Company’s name, address, contact details or Location Information Officer change; and when it rewrites sentences to be easier to understand without changing their meaning.
- When making a change, the Company posts the effective date, the reason for the change, and the text before and after the change on this page from 30 days before the change takes effect. At the same time, it separately notifies members who have given location consent through “Notices” under MY and push notifications (on devices that allow notifications), and if they open the app or website before the effective date, it shows the changes on screen. However, changes that do not affect users’ rights and obligations, such as correcting the Company’s address or contact details or only polishing the wording, are announced by posting them on this page from 7 days before they take effect, and take effect without asking for consent.
- For the following changes, the Company asks members for consent again before the change takes effect. A member who does not consent again only loses the use of location features and can keep using everything else.
- Changes that add features or purposes for which location is used
- Changes that make the location sent to the server more precise (making the rounding units in Article 4 smaller), and changes under which location is sent together with sign-in information
- Changes under which location is given to other people
- Changes to where map data comes from (the map service), and changes that add places to which your device sends the area around your location
- Changes that add to what is kept or lengthen how long it is kept
- Any other changes that are unfavorable to users
- For a change notified separately under paragraph 3 that does not fall under paragraph 4, the notice will also state “If you do not object by the effective date, you will be treated as agreeing.” If a member does not object by the effective date, the member is treated as agreeing to the changed Terms. To object, withdraw your location consent (Article 10). Withdrawing leaves your membership and other features as they are. A member who has not seen the changes on screen by the effective date is shown them first the next time they use a location feature after the effective date.
Article 4 (What the Service does)
The Company provides the following two location features in the same way in the iOS app, the Android app and on the web (bapsanglog.com).

- Your location is found and reported by your device’s operating system (iOS or Android) or browser. The Company does not measure location itself.
- Exact coordinates are not sent to the Company’s servers; only the rounded values shown in the table above are sent. The map’s compass heading is not sent to the server.
- Requests that contain location do not carry sign-in information. The server uses the coordinates it receives to find nearby places, returns them, and does not store the coordinates (Article 7). However, when a member uses a location feature, when and which feature was used is kept with the account as a use record under Article 8.
- Even when location features are not in use, the map sends the center and extent of the map in the same way to find places in the area shown. If the map was opened at your location, the first area sent is near your location; if you move the map, the area you moved to is sent.
- The map is drawn using the map service of Kakao Corp. To draw the map, your device gets the map data for the area in view directly from Kakao, and these requests contain that area and your device’s IP address. The size of the area Kakao receives depends on how far the map is zoomed in. The Company’s servers do not send coordinates to Kakao. If the map is opened at your location, that area is near your location.
- Non-members who are not signed in are also shown the same notice before their location is used. Non-members, too, can use location features only after consenting, and their choice is saved only on that device (on the web, in that browser). A non-member’s location is also rounded in the same way, sent without sign-in information and not stored, so the Company uses it without knowing whose location it is. When a non-member signs in, the Company asks for location consent separately, as a member.
Article 5 (Fees and conditions)
- Location features are free. Mobile data charges depend on the mobile plan you subscribe to.
- Location features can be used by members aged 16 or older who have given location consent. For non-members, Article 4(6) applies.
- Location consent is optional. Even if you do not consent, you can still use everything that does not need location, such as signing up, rating, saving places and browsing. If you do not consent, the map opens at a preset location (Seongsu, Seoul), and “Near me” and the my-location button on the map (“Go to my location”) cannot be used (tapping them shows the location notice). You can still move the map by hand to find places.
- For location features to work, you must also allow location permission on your device (what the operating system or browser asks for) in addition to giving location consent. The two are separate. You can turn off your device’s location permission at any time in your phone or browser settings.
Article 6 (Location consent)
- Before using a member’s location, the Company shows these Terms and asks for consent. Consent is given in one of the following places.
- When signing up — On the screen where you choose your nickname, select the [optional] item “I agree to the Location-Based Services Terms.” Selecting this item means you consent to the use of your location for the two features in Article 4. It is off at first, and is selected separately from the [required] item “I'm 16 or older, I agree to the Terms of Service, and I've read the Privacy Policy.”
- On the terms review screen — The screen that asks members who have already signed up to agree to the Terms of Service again has the same [optional] item.
- When you first use a location feature — If you try to use a location feature without having consented (for example, when you tap “Near me” or the my-location button on the map (“Go to my location”)), a notice appears with a summary and a link to these Terms. Tapping “Agree and use location” gives your consent, and only after that does your device ask for location permission.
- In settings — Turn on location consent in MY → ☰ (Settings) → Location.
- Until it has your location consent, the Company does not ask for your device’s location permission and does not read or send your location.
- Location consent is saved to your account and applies to the iOS app, the Android app and the web wherever you use the same account. Your device’s location permission is asked for separately on each device.
- If you want to use only one of the two location features, turn off the feature you will not use in MY → ☰ (Settings) → Location after consenting. Turning off a feature is treated as withdrawing consent for that feature (Article 10(2)).
- To prove that consent was obtained, each time you give or withdraw location consent, pause or resume, or turn a feature off or on, the Company records the version of these Terms at that time (its effective date), the time, and where it was done (iOS app, Android app or web). This record does not contain location. It is kept even after you withdraw location consent, until you delete your account, and is deleted when you delete your account.
Article 7 (Purpose of use and retention of personal location information)
- The Company uses members’ location only for the two features in Article 4. The purposes are to find and show nearby places and to open the map at your location.
- The server does not store the coordinates it receives. They are destroyed immediately once nearby places are found and returned. The Company also does not ask for consent to keep location separately.
- The use records in Article 8 do not contain coordinates.
Article 8 (Use records — records confirming the use and provision of location information)
Under Article 16(2) of the Location Information Act, the Company automatically records the fact that location was used. The Company keeps two kinds of records, and neither contains coordinates or IP addresses.

- All location is obtained from the device’s operating system or browser (source) and used on the server to find nearby places (how it was used), and the Company does not provide the location it receives to third parties (no recipient — Article 9).
- The retention period is 6 months (for copies remaining in backups, see paragraph 5). After 6 months, records are deleted automatically. The basis for retention is Article 16(2) of the Location Information Act, and the period follows the Korea Media and Communications Commission (KMCC) Notice “Standards for Administrative and Technical Protection Measures for Location Information.”
- If a member withdraws location consent, that member’s use records are deleted immediately. If a member turns off one feature, that feature’s use records are deleted immediately. They are also deleted when the member deletes their account. The server’s location request count log does not show whose requests it contains, so it is deleted once 6 months have passed.
- The Company uses use records only to confirm the fact that location was used and to respond to users’ requests (Article 10) and to inspections under the law.
- Deleted records disappear from the Service’s database immediately. Copies remaining in the database backups kept in case of failure disappear as well once the backup retention period (up to 7 days) has passed. The Company does not use backups for anything other than recovering from failures. If data is restored from a backup, records are deleted again to reflect the consent withdrawals, feature turn-offs and account deletions identified after the restore.
- Separately from these two records, the request logs of the company that operates the servers keep the access time and IP address of requests that contain location, just as for other requests, and are deleted after up to 7 days (Privacy Policy section 7).
Article 9 (Provision of personal location information to third parties)
- The Company does not provide the personal location information it receives to third parties. Accordingly, there is also no notice given each time it is provided. The requests your device sends directly to Kakao to get map data are described in Article 4(5).
- If the Company adds a feature that gives a member’s location to a person the member designates, the Company will first change these Terms, tell members the recipient and the purpose of provision, and obtain their consent in advance. In that case, each time location is provided, the Company will immediately send a notice stating the recipient, the date and time of provision and the purpose of provision to the device from which the location was obtained (or, if the member has designated another device or an email address in advance, to that device or address). Notifying in batches will be used only if the member has separately consented to it, and even then the batching period will not exceed 30 days.
- The Company does not use personal location information or use records beyond the scope stated in these Terms, or give them to anyone else. The only exception is where a special provision of law requires it.
Article 10 (Your rights and how to use them)
Members can do the following at any time — directly in MY → ☰ (Settings) → Location in the app or on the web, or by requesting it by email (admin@thenonscale.com).
- Withdrawing consent — Turning off location consent in the “Location” settings withdraws it. The withdrawal is saved to your account and applies to every device using the same account, and that member’s use records are deleted immediately. Your membership and other features stay as they are.
- Turning off by feature (partial withdrawal) — In the “Location” settings, you can turn off “Near me” or “My location on the map” separately. Turning off a feature is treated as withdrawing consent for that feature, and that feature’s use records are deleted immediately. A feature that is turned off neither gets nor sends your location. What you turn off is saved to your account and applies to all devices; if you turn it back on, you can use that feature again.
- Pausing — Turning on “Pause” in the “Location” settings stops all location features until you turn it off again. This is saved to your account and applies to every device using the same account. While paused, your location is neither obtained nor sent, and no new member use records are created. Records already kept are not deleted and are kept as described in Article 8. To delete the records as well, turn off features or withdraw consent.
- Access, disclosure and correction — You can ask to be shown or told your use records, and you can also ask for the reasons for and details of any provision of your location to third parties (if it has never been provided, the Company will say so). If something in the records is wrong, you can ask for it to be corrected. Send your request by email; the email address for requests is also shown in MY → ☰ (Settings) → Location.
If you make a request by email, the Company may ask you a few questions to confirm that it is you. Withdrawing consent, turning off by feature and pausing are not refused, and are applied immediately once your identity is confirmed. Requests for access, disclosure and correction are handled without delay, and at the latest within 10 days of the day the request is received, and are not refused without a justifiable reason. If the Company refuses a request or grants it only in part, it will tell you why. If you disagree with that decision, you can ask by email for it to be reviewed again, or apply for mediation under Article 18.
A non-member’s location is used without knowing whose it is and is not stored, so there are no per-person records to show or delete. Non-members, too, can turn off the choice to use location on that device at any time in MY → ☰ (Settings) → Location, and once it is off, that device does not send your location. Turning off the device’s location permission also stops your location from being sent. The choice made on that device is also deleted when the app is deleted or the browser storage is cleared. On iPhone, however, it may remain in the device’s secure storage even after the app is deleted, so the choice may carry over if the app is installed again on the same device (Privacy Policy section 8).
Article 11 (Children under 14 and legal representatives)
- Only people aged 16 or older can sign up for BapsangLog (Terms of Service). The Company does not use the personal location information of children under 14, so it has no procedure for obtaining the consent of a legal representative.
- If the Company learns of circumstances suggesting that a member is under 16, it immediately restricts that account under Article 4(3) of the Terms of Service and tells the member why. The member can state their age or appeal within 14 days of the day they receive the notice. If the member is confirmed to be under 16, or if 14 days pass without any response, the Company terminates the agreement and deletes that account. At that time, the ratings and “Haven't been” marks the member left, and their location consent records and use records, are deleted as well.
- A legal representative who believes that the location of a child under 14 has been used should let the Company know by email. After confirming that the person is the legal representative, the Company will let the legal representative exercise the rights in Article 10 (withdrawing consent, turning off by feature, pausing, and access, disclosure and correction) on the child’s behalf, and will handle them without delay. If the legal representative wishes, the Company will tell them the child’s use records before deleting the account, and will then delete them under paragraph 2.
Article 12 (Guardians of Children Aged 8 or Under, etc.)
- BapsangLog’s location features are for finding nearby places; they are not a service for protecting anyone’s life or physical safety. So even if the Company receives the consent in paragraph 2, it does not use location on the basis of that consent. Even so, the rights of guardians under the Location Information Act are set out below.
- If the guardian with a duty of protection of any of the following persons (“Children Aged 8 or Under, etc.”) consents to the use of that person’s personal location information to protect that person’s life or physical safety, the person is treated as having consented.
- Children aged 8 or under
- Adults under full guardianship
- Persons with a mental disability under Article 2(2)2 of the Act on Welfare of Persons with Disabilities who fall under persons with severe disabilities under item 2 of Article 2 of the Act on the Employment Promotion and Vocational Rehabilitation of Persons with Disabilities (only those registered as persons with disabilities under Article 32 of the Act on Welfare of Persons with Disabilities)
- A guardian with a duty of protection is a person who actually protects the Child Aged 8 or Under, etc., as set out in Article 26(2) of the Location Information Act — such as the legal representative or guardian of a child aged 8 or under, or the legal representative of an adult under full guardianship.
- A guardian who wishes to consent must submit to the Company a written consent form that states the following and bears their name and seal, or signature, together with a document proving that they are the guardian with a duty of protection (to the address or email in Article 20).
- The name, address and date of birth of the Child Aged 8 or Under, etc.
- The guardian’s name, address and contact details
- The fact that the purpose of using location is limited to protecting the life or physical safety of the Child Aged 8 or Under, etc.
- The date of consent
- The guardian can exercise all the rights in Article 10 by requesting them by email. Children aged 8 or under cannot sign up, so if the Company learns from a written consent form that a child aged 8 or under has an account, it deletes that account under Article 11(2).
Article 13 (Location Information Officer)
The Company designates the following person as responsible for protecting location information and handling complaints about location.

Article 14 (Changes to and suspension of the Service)
- When the Company adds or changes location features, it first amends Article 4 of these Terms and gives notice under Article 3.
- The Company may suspend location features temporarily for equipment maintenance, failures, or where required by law. During that time, the server returns empty results to requests that contain location, so places may not appear in “Near me” or in the map, list and search results in “Explore.” While location features are suspended, the app and website tell you that they cannot be used right now. For planned suspensions, the Company announces the reason and period in advance on the Service’s screens or on its website (bapsanglog.com). If a suspension is expected to last more than 30 days, the Company follows the procedure for suspending the business in Article 17(2).
- Other changes to and suspension of the Service are governed by the Terms of Service.
Article 15 (Compensation for damages)
If a user suffers damage because the Company has violated Articles 15 to 26 of the Location Information Act, the user may claim compensation for damages from the Company. In that case, the Company cannot escape liability unless it proves that there was no intent or negligence on its part.
Article 16 (Limits of liability)
- Location is reported by your device’s operating system or browser, so it may differ from your actual location depending on the device and network conditions. Also, because searches use rounded location, “Near me” results are approximate.
- The Company is not liable for the following damage that arises without intent or negligence on the Company’s part.
- Damage caused because the location reported by a device or browser differed from the actual location
- Damage caused by natural disasters, or by failures of communications or external services (such as Kakao Map) beyond the Company’s control
- Damage caused because a user could not use location features for reasons on the user’s side, such as turning off location permission on their device
- This Article does not reduce the Company’s liability for damage caused by its intent or negligence, its liability under Article 15, or any other liability that cannot be reduced by law.
Article 17 (Transfer, suspension or closure of the business)
- If the Company transfers all or part of its location-based service business, or the business passes to another by merger, inheritance or the like, the transferee will notify users of the following within 30 days: the fact of the transfer; the transferee’s name, address, phone number and other contact details; and the measures to protect users’ rights and location.
- If the Company intends to suspend all or part of its location-based service business (suspension), it will set a suspension period, notify users of it at least 30 days before the suspension begins, and file with the KMCC. The suspension period will not exceed 1 year, and when the suspension begins, the Company will destroy the personal location information of that business.
- If the Company intends to close all or part of its location-based service business (closure), it will notify users at least 30 days before closing and file with the KMCC. When closing, it will destroy all personal location information and use records of that business.
- Notices under paragraphs 1 to 3 are given to each member through “Notices” under MY and push notifications (on devices that allow notifications), and are posted on the website (bapsanglog.com) for at least 30 days. The Company does not collect email addresses or phone numbers at sign-up, so it does not give these notices by email or text message.
Article 18 (Dispute mediation)
- Please first bring any complaint or dispute about location to the officer in Article 13. The Company will consult with you in good faith.
- If consultation does not resolve the matter or is not possible, the Company may apply to the KMCC for a ruling (Article 28(1) of the Location Information Act), and the Company and users may apply for mediation to the Personal Information Dispute Mediation Committee (1833-6972 (in Korea) · www.kopico.go.kr) (Article 28(2) of the same Act).
- Other places to get counseling or report infringements of personal information are listed in the Privacy Policy.
Article 19 (Governing law and language)
- These Terms are governed by the laws of the Republic of Korea. However, this provision does not reduce the rights that the law of the country where a user lives guarantees to consumers. Jurisdiction is as set out in the Terms of Service.
- The Korean version of these Terms is the authoritative version. The English version is a translation, and if the meanings differ, the Korean version prevails. However, for consumers who live in the European Economic Area, the United Kingdom or Switzerland, the English version is equally authoritative with the Korean version, and if the meanings of the two versions differ, the one more favorable to that consumer prevails.
Article 20 (Company information and inquiries)

Addendum
- These Terms take effect on October 5, 2026.
- From this date, members who signed up before it must also agree to these Terms to use location features. This applies even if they previously allowed location permission on their device. How to consent is described in Article 6(1). Even a member who signed up under the previous Terms of Service cannot agree to these Terms if they are under 16 (Article 5(2)).
